In a major development that could set a precedent in J&K’s real estate sector, the Royal Nest Sapphire Apartments Owners Association (RNSAOA) has approached the Hon’ble High Court of Jammu & Kashmir and Ladakh. Seeking a Central Bureau of Investigation (CBI) and Enforcement Directorate (ED) investigation against Omkar Nest Pvt Ltd and its directors alleging serious violations in offering possession of flats without obtaining mandatory statutory approvals, including the Occupancy Certficate.The Association, represented before the Hon’ble High Court by Mr. Sunil Sethi, Learned Senior Advocate and Mr. Aradhay Gupta, Advocate, has alleged serious lapses by the Developer Mr. Vimal Kumar, in the Royal nest Sapphire residential
project located at Kunjwani Bypass Road, Jammu. The petition claimns that the builder
delivered possession of apartments in blatant violation of legal requirements, thereby compromising the safety and well-being of home- buyers.
The home buyers have highlighted a pattern of alleged cost-cutting measures adopted by the developer throughout the éxecution of the project including standard of construction quality, use of inferior material and poor workmanship. Tihey have also pointed out a significant gap between the promised “world class” amenities at the time of booking and the facilities actually delivered.
Landmark Implications:
This case gains added significance as it is among the first instances in the Union Territory of Jammu & Kashmir where homebuyers have sought criminal proceedings against a builder following the implementation of the RERA Act, 2016. The petitioners believe that the outcome could serve a strong deterrent against misleading promises and unethical practices in the regional real estate market.
The Association approached the Hon’ble High Court only after exhausting all other available remedies. A group of buyers had earier raised their grievances before the J&K Real Estate Regulatory Authority. However, they found the authority to be slow in addressing and resolving genuine concerns brought to its notice due to less effective redressal mechanism.
Court’s Intervention:
Taking cognizance of the serious allegations, the Hon’ble High Court vide its order dated 15-04-2026 read with order dated 30-04-2026 was pleased to issue notices in the pettion to the Central Bureau of Investigation (CBI), Enforcement Directorate (ED)and multiple other governmental and regulatory authorties, including the Union Terrtory administration, J&K RERA, Jamiu Municipal Corporation, Fire Department and Jal Shakti Department. The Cour has also directed maintenance of Status Quo over the common areas of the project.
The petttoners have urged the strict enforcement of real estate regulations and accountabiliy for the alleged violations to safeguard the interests of thousands of homebuyers across the region, who have committed signifcant personal savings toward the purchase of their homes.
