JMC Sleeping Like Kumbhkaran: Illegal Construction Booms in Shastri Nagar

No setback maintained, no notice issued, and construction completed unchecked — serious questions on JMC enforcement

Jammu, March 2026: A shocking case of alleged building violations has surfaced in Shastri Nagar, Ward 22, exposing serious lapses in the functioning of the Jammu Municipal Corporation (JMC). A residential building approved under BP/ORDER/JMC/2023/2707 (Application No. JMC/2023/4320) appears to have been constructed in clear violation of sanctioned building norms, with no visible enforcement action taken during the entire construction period.

As per official records, the building plan was approved on 11/04/2023, with mandatory provisions for setbacks — 5.50 meters in the front, 2.43 meters at the rear, and 2.13 meters on the side. However, on-ground reports and photographic evidence indicate that no front setback has been maintained, and a room has been constructed in the area where open space was legally required.

Blatant Violation of Approved Plan

The construction not only violates setback norms but also raises concerns of excess ground coverage and deviation from the approved FAR (Floor Area Ratio). Such violations are a direct breach of:

  • J&K Control of Building Operations Act, 1988
  • Unified Building Bye-Laws (ULBs)
  • Jammu Master Plan Regulations

These laws clearly mandate strict adherence to approved building plans and provide for immediate action in case of violations, including stop-work notices, sealing, and demolition.

3 Years, No Action — How?

Despite the plan being approved in March 2023, the construction reportedly continued uninterrupted and was fully completed by early 2026.

This raises serious and uncomfortable questions:

  • Why was no stop-work notice issued during construction?
  • Why did the Enforcement Wing of JMC remain inactive?
  • Were site inspections conducted at all?

Even more concerning is that no notice under relevant provisions of the Building Operations Act appears to have been served, indicating a complete breakdown of regulatory oversight.

Not an Isolated Case

Local residents claim that this is not a one-off incident, but part of a larger pattern. Similar violations are reportedly occurring across multiple wards in Jammu, pointing towards systemic failure within JMC’s enforcement mechanism.

Officials Under Scanner

The role of field inspectors, junior engineers, and enforcement staff is now under serious scrutiny. Questions are being raised about:

  • Possible negligence or deliberate inaction
  • Lack of monitoring during critical construction phases
  • Accountability of officers responsible for field inspections

Citizens are demanding that strict departmental action be initiated against officials who failed in their duties.

Public Safety Compromised

Ignoring building regulations is not just a legal violation — it directly endangers public safety:

  • Obstruction of emergency access routes
  • Increased fire hazards
  • Poor ventilation and structural risks

Such unchecked constructions can have serious consequences for residents and surrounding properties.

Call for Immediate Action

Residents and concerned citizens have urged higher authorities to:

  • Conduct an immediate on-site inspection
  • Take strict legal action against the violator
  • Initiate an independent inquiry into JMC Enforcement Wing
  • Fix accountability of responsible officials

Conclusion

The Shastri Nagar case highlights a disturbing reality — while rules exist on paper, enforcement remains absent on the ground.

If timely action is not taken, such violations will continue to spread, undermining urban planning, governance, and public trust.
