The Delhi High Court<\/strong> has sought the stand of the city police regarding activist Umar Khalid’s<\/strong> plea for bail under the Unlawful Activities (Prevention) Act<\/strong> (UAPA). This plea pertains to the alleged “larger conspiracy” behind the February 2020 riots in north-east Delhi. The court has given the Delhi Police two weeks to submit their response.<\/p>\n

A bench comprising Justices Prathiba M. Singh<\/strong> and Vikas Mahajan<\/strong> issued a notice in this matter on Friday, indicating the seriousness of Khalid’s application.<\/p>\n

Khalid’s counsel emphasized that this represents the activist’s third attempt at securing bail since his arrest in September 2020. Alongside his main plea, he also seeks interim bail<\/strong>.<\/p>\n

The bench has scheduled the hearing for Khalid’s plea on August 27<\/strong>, coinciding with the bail plea for co-accused Sharjeel Imam. Both cases will likely be examined together, as they are interlinked.<\/p>\n

Khalid’s current application challenges a trial court’s decision made on July 4, which rejected his previous bail request. Raju<\/strong>, representing the Delhi Police, confirmed that Imam’s bail plea was also denied by the same trial court, reinforcing the idea that these cases can be provisioned concurrently. The riots, which erupted amid protests against the Citizenship (Amendment) Act (CAA)<\/strong>, led to extensive violence, resulting in the deaths of 53 individuals and injuring over 700 others. Khalid and several others, including Imam and former AAP councillor Tahir Hussain<\/strong>, are charged with involvement in broader conspiracy efforts, with investigations carried out by the Delhi Police’s Special Cell.<\/p>\n

The trial court’s earlier rejection of Khalid’s bail stated that adherence to the Supreme Court’s prior ruling left them without alternative options concerning his plea. In a later decision on September 2, 2025, a high court division bench similarly denied Khalid bail, a ruling that the Supreme Court reaffirmed on January 5.<\/p>\n

However, the Supreme Court did approve bail for other co-accused including Gulfisha Fatima<\/strong>, Meeran Haider<\/strong>, Shifa Ur Rehman<\/strong>, Mohammad Saleem Khan<\/strong>, and Shadab Ahmad<\/strong>. The apex court articulated that there existed a prima facie case against both Khalid and Imam under the UAPA, indicating a nuanced understanding of involvement in the events that unfolded.<\/p>\n
