{"id":64875,"date":"2026-01-21T10:42:58","date_gmt":"2026-01-21T10:42:58","guid":{"rendered":"https:\/\/earlypostdaily.com\/index.php\/2026\/01\/21\/additional-trial-courts-will-make-justice-system-more-robust-supreme-court\/"},"modified":"2026-01-21T10:42:58","modified_gmt":"2026-01-21T10:42:58","slug":"additional-trial-courts-will-make-justice-system-more-robust-supreme-court","status":"publish","type":"post","link":"https:\/\/earlypostdaily.com\/index.php\/2026\/01\/21\/additional-trial-courts-will-make-justice-system-more-robust-supreme-court\/","title":{"rendered":"Additional Trial Courts Will Make Justice System More Robust: Supreme Court"},"content":{"rendered":"<p>The Supreme Court on Wednesday said the setting up of <strong>additional trial courts<\/strong> would make the judicial system more <strong>robust<\/strong>, reducing the need for accused persons to approach the apex court for reliefs such as <strong>bail or expeditious hearing<\/strong> in criminal cases.<\/p>\n<p>A bench comprising <strong>Chief Justice of India Surya Kant<\/strong> and <strong>Justices Joymalya Bagchi and Vipul M Pancholi<\/strong> made the observation while hearing a bail plea in a <strong>2021 ISIS-linked case<\/strong> being probed by the <strong>National Investigation Agency (NIA)<\/strong>.<\/p>\n<p>\u201cThe idea is how do you make a robust mechanism that none of them are required to come to the courts? And that will happen when additional courts are set up,\u201d the CJI said.<\/p>\n<p>The bench sought an update from <strong>Additional Solicitor General Aishwarya Bhati<\/strong>, appearing for the Centre, on the progress in setting up a <strong>special trial court in Delhi<\/strong>, as earlier suggested by the court. It directed the law officer to apprise it of the developments by <strong>February 10<\/strong>, when the matter will be taken up next.<\/p>\n<p>On <strong>January 6<\/strong>, the top court had asked the Centre and the Delhi government to consider establishing a special court to conduct a <strong>day-to-day trial<\/strong> in the case, which involves the examination of <strong>125 witnesses<\/strong>.<\/p>\n<p>The court was hearing the bail plea of <strong>Md Heydaitullah<\/strong>, accused of using <strong>Telegram groups<\/strong> to propagate the ideology of the <strong>ISIS<\/strong> terror outfit and recruit persons in India.<\/p>\n<p>The CJI reiterated that <strong>inordinate delay in trial<\/strong> lends legitimacy to arguments that an accused cannot be kept in custody for prolonged periods without commencement or completion of trial.<\/p>\n<p>Earlier, the <strong>Delhi High Court<\/strong> had rejected Heydaitullah\u2019s bail plea, holding that he was not a \u201cpassive\u201d supporter of ISIS.
