The Jammu Municipal Corporation’s (JMC) notices under the JMC Act 2000 have been rendered ineffective due to a lack of follow-up action against violators. Despite enforcement staff issuing notices, no concrete action is taken against those who flout construction regu-lations, leading to a surge in unauthorised constructions within Municipal Corporation areas. Notices issued under the JMC Act 2000 have failed to deter vio-lators, as no meaningful action is taken against them.Enforcement staff’s actions appear to be superfi-cial, with violators being allowed to continue with unauthorised constructions after being issued notices. The lack of effective enforcement has led to a boom in unau-thorised constructions, com-promising the city’s infra-structure and aesthetic appeal.<\/p>\n
In this regard, unautho rized commercial construc-tion was going on in Lajpat Nagar, Canal road, Ward-19 without JMC permission & maintaining mandatory set-backs. Despite aggrieved locals bringing the same into kind notice of concerned Enforcement staff, nothing was done in this regard against JMP-2032 and UBBL-2021. However when this newspaper published a detailed story along with pic-tures, JMC woke up from slumber and served owner notice under section 253(1) of JMC Act, 2000 vide No, JMC\/DC(N)\/Enf\/991-94 dated 11-06-2025 when vio-lated construction was at advanced stage of construc-tion but this notice proved mere eyewash as no follow up action taken. Enforcement staff fails to understand that unauthorized constructions put a strain on the city’s infra-structure, including water supply, sewage, and trans-portation systems. Unauthorized constructions pose safety risks to residents, particularly in cases of build ings that do not meet safety standards.<\/p>\n
The JMC needs to take immediate action to address this issue by ensuring that enforcement staff takes con crete action against violators, including demolishing unau-thorized constructions, streamlining the process of issuing notices and taking action against violators to prevent delays and corrup-tion. Ensuring transparency and accountability in the enforcement process to pre vent corruption and ensure that action is taken against those who flout regulations. By taking these steps, the JMC can ensure that unauthorised construc-tions are brought under con-trol, and the city’s infrastruc-ture and aesthetic appeal are preserved.<\/p>\n
It has been established that these illegal constructions are carried out due to care-lessness and negligence of the field staff who are entrusted with responsibili-ty of checking such illegal constructions well in time. It has generally been observed that in case of major viola-tions, the enforcement wings don’t prefer to visit the spot till the violators complete several floors and thereafter such major violations get compounded through Tribunal.
