The High Court<\/strong> has directed the Director of the Social Welfare Department<\/strong> to appear in person if a detailed affidavit<\/strong> regarding the establishment of shelter homes for destitute women<\/strong> across Jammu and Kashmir is not submitted by the next hearing.<\/p>\n

A Division Bench<\/strong> comprising Chief Justice Tashi Rabstan<\/strong> and Justice M.A. Chowdhary<\/strong> issued the order while hearing a Public Interest Litigation (PIL)<\/strong> filed by Mehram Women Cell Kashmir<\/em>. The petition seeks the implementation of the Domestic Violence Act, 2005<\/strong>, which mandates the establishment of shelter homes for women in distress.<\/p>\n

Previously, the court had granted the government four weeks<\/strong> to respond to concerns raised by the petitioner over an \u201cinadequate\u201d status report<\/strong> submitted by the authorities. However, the required detailed affidavit<\/strong> had not been filed by the given deadline.<\/p>\n

During the latest hearing, the court reiterated its directive<\/strong>, warning that failure to comply would require the Director of Social Welfare to be present in person<\/strong> on the next date of hearing.<\/p>\n

“Faheem Nissar Shah, GA, seeks and is granted further one week\u2019s time as a final opportunity, failing which the Director of Social Welfare shall appear in person on the next date of hearing. List again on 16-04-2025,”<\/em> the Division Bench ordered.<\/p>\n

The case underscores the urgency of ensuring adequate infrastructure and resources<\/strong> for implementing the Domestic Violence Act, 2005<\/strong>, across Jammu and Kashmir.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n
