The five-day extradition trial of fugitive diamantaire Nirav Modi to \nface charges of major financial offences in India is set to begin in the\n Westminster Magistrates Court on Monday, with New Delhi making a second\n extradition request in February.<\/p>\n\n\n\n
Modi, 49, is now the subject of \ntwo extradition requests; one processed by the Central Bureau of \nInvestigation (CBI) and the other by the Enforcement Directorate (ED). \nLodged in the Wandsworth jail since arrest in March 2019, he has been \nrefused bail five times.<\/p>\n\n\n\n
The Crown Prosecution Service (CPS), \nwhich represents India in UK courts, said Modi is likely to take part in\n the extradition trial by video-link. Charges against Modi involve a \nMumbai branch of the Punjab National Bank (PNB) that extended his \ncompanies loans worth over Rs 11,300 crore.<\/p>\n\n\n\n
Modi is the subject of\n two sets of criminal proceedings. The CBI case relates to large-scale \nfraud upon PNB, through the fraudulent obtaining of Letters of \nUnderstanding (LOUs\/loan agreements); the ED case relates to the \nlaundering of the proceeds of that fraud.<\/p>\n\n\n\n\n\n
The\n second extradition request was made on the basis of two additional \noffences as part of the CBI case. It was certified by home secretary \nPriti Patel on February 20 as required under the 1993 India-UK \nextradition treaty.<\/p>\n\n\n\n
The additional offences relate to allegations \nthat Modi interfered with the CBI investigation by \u201ccausing \ndisappearance of evidence\u201d and intimidating witnesses (\u201dcriminal \nintimidation to cause death\u201d). They have not been joined to the CBI \ncase, but will be dealt with at a separate later hearing likely in July,\n the CPS said.<\/p>\n\n\n\n
Despite offering to raise the bail security amount \nto 4 million pounds, UK courts have refused Modi bail on the ground that\n he posed a flight risk and had the means to influence witnesses and \ntamper with evidence.<\/p>\n","protected":false},"excerpt":{"rendered":"
